What is the procedure for claiming compensation in the UK?

STEP 1: Contact our office and provide us with the details of the accident

This is the first step in applying for compensation. Our consultants will obtain the necessary information on your case and after consultation with the manager we will decide whether we can deal with the case.

STEP 2: Referral law firm

Your case is sent to one of our specialist injury solicitor firms. We decide which firm best suites your needs and demand; they then do an extensive evaluation of your chances of winning the case, if it were to ever go to court; free of charge.

STEP 3: Opening your case

Following the successful evaluation of your chances of winning the case if it were ever go to court, your case is given to one of the specialist lawyers, which works for one of our trusted solicitor firms. Based on the information which we gathered in STEP 1, the solicitor will then decide who exactly will be responsible for paying out the compensation for personal injury and vehicle damage (when it is a road traffic accident its usually the Third Party’s insurance company which covers all the costs.) You should not directly contact any of the parties involved in the accident, as all correspondence will be done via the solicitors.

STEP 4: Investigation proceedings

The time taken for a Personal Injury or a Vehicle Damage case to be finalised may range from anything from one month to twelve months or longer depending on the complexity of the case and the cooperation of the third party. During this period the solicitors are constantly compiling evidence regarding your case. One major requirement you have to do is to attend a pre arraigned medical appointment. This is a major step in the process when claiming compensation for personal injury. The solicitors then compile all this information, and present them to the other party’s insurer.

STEP 5: Negotiation

After analysing the evidence which was submitting by our solicitors, the Third Party’s Insurer will decide on their position (they can admit liability, deny it or do their own investigation). If the Third Party’s Insurer, decide to put forward an offer, our solicitors will advise you of the best course of action. If this offer will be rejected, the case will be taken to court, where the judge will determine the amount which should be awarded to you.

STEP 6: Compensation payment

You receive full damages awarded to you, regardless of whether the case will end with an out of court settlement or will go to court.
